1. Acceptance of Terms

By accessing or using the BowerzLabs Technologies website or services, you agree to be bound by these Terms and Conditions. If you do not agree, you must discontinue use immediately. You confirm that you are at least 18 years old or have legal consent from a parent or guardian.

2. Services Overview

We build high-performance tech across various domains.

BowerzLabs Technologies provides software development, product design, consulting, research, experimentation, and digital solutions including web applications, mobile applications, SaaS platforms, data systems, gaming, and emerging technologies. Services may be updated, modified, or discontinued at our discretion.

3. Client Engagements & Deliverables

Specific project contracts override these general terms.

Specific project scope, timelines, pricing, and deliverables are defined in separate written agreements, proposals, or statements of work (SOW). In the event of a conflict, those documents take precedence over these Terms.

4. Intellectual Property Rights

You own the custom code once the bill is settled.

All website content, trademarks, logos, designs, and proprietary materials are owned by BowerzLabs Technologies unless otherwise stated. For client projects, ownership of code and deliverables transfers to the client upon full payment, excluding third-party libraries which retain their original licenses.

5. Payments & Fees

Deposits reserve our capacity; timely payments keep the build moving.

Project fees, payment schedules, and billing models (fixed-price, time & materials, or retainers) are defined in written agreements. New engagements typically require an upfront deposit to reserve delivery capacity. Late payments may result in paused or terminated services.

6. User & Client Responsibilities

We need your honest input and lawful cooperation.

You agree to use our services only for lawful purposes and not to engage in activities that may damage systems, data, reputation, or violate applicable laws. You are responsible for providing accurate project requirements, timely feedback, and required access.

7. Confidentiality & Data Protection

Your secrets are safe with us.

Any non-public information shared during discussions or project execution is treated as confidential. We may enter into NDAs or Data Processing Agreements (DPA) where required. Confidential information will not be disclosed except where required by law or agreed in writing.

8. Post-Launch Support & Maintenance

Long-term maintenance is handled via separate support agreements.

Post-launch support, warranties, maintenance, or service level agreements (SLAs) are provided only if explicitly agreed in writing. Ongoing support may be offered via retainers or ad-hoc arrangements.

9. Disclaimer of Warranties

We build to high standards, but provide tech 'as-is' legally.

All services and materials are provided on an “as is” and “as available” basis. BowerzLabs Technologies makes no warranties, express or implied, including merchantability, fitness for a particular purpose, or uninterrupted availability.

10. Limitation of Liability

Our liability is limited to the extent the law allows.

To the maximum extent permitted by law, BowerzLabs Technologies shall not be liable for indirect, incidental, special, or consequential damages, including loss of profits, data, or business opportunities arising from the use or inability to use our services.

11. Termination

We can stop work if terms are breached or risks arise.

We reserve the right to suspend or terminate services or access if these Terms are violated, payments are overdue, or continued engagement poses legal or operational risk.

12. Governing Law

These terms follow Kenyan law.

These Terms and Conditions are governed by and interpreted in accordance with the laws of the Republic of Kenya, without regard to conflict of law principles.

13. Updates to These Terms

Check back occasionally for updates.

We may revise these Terms periodically. Continued use of our website or services after updates are published constitutes acceptance of the revised Terms.
